1. Terms & Conditions 1.1. Job Safety Assistance Pty Ltd (JSA) reserves the right to make changes to the "registration terms and conditions" (the terms) as and when required without notice to you;
1.2. Any changes to "the terms" will be posted on this site and can be reviewed by following the link to this page; you shall be responsible for reviewing and becoming familiar with any such modifications;
1.3. "JSA" its employees and/or representatives disclaim any liability, convoluted or contractual for any financial losses or damage that may result from changes to these terms and conditions;
1.4. It is the responsibility of the person/s registering to ensure they have read and understand all of "the terms" listed;
1.5. The person/s completing the registration form confirms that they have the authority to authorise payment for each participant listed on the completed registration form;
1.7. "JSA" its employees and/or representatives disclaim any liability, convoluted or contractual for any financial losses or damage that may result from participants not securing personal items while at the training venue;
1.8. The person/s completing the registration form grant "JSA" permission to collect and retain the personal information entered into the registration form;
1.10. "JSA" will decide the venue to be used for public cousres and will be based on participant numners and location;
1.11. "JSA" reserves the right to relocate any public course to a venue that is more suitable to the couse;
1.12. Any relocation of venue will be notified to each participant by email prior to the course commencement date;
1.13. "JSA" its employees and/or representatives disclaim any liability, convoluted or contractual for any financial losses that may result from relacting to another venue;
1.14. Car parking for participants is not provided by "JSA" and is available in public parking areas or parking areas provided by the venue;
1.15. "JSA" has no vested interest in any venue used for training and as such has no control over parking terms and conditions;
1.16 Participants parking in either public areas or areas provided by thye venaue park at their own risk;
1.17. "JSA" its employees and/or representatives disclaim any liability, convoluted or contractual for any financial losses or damage that may result from parking either within an area provided by the venue or in any public area;
1.18. Participants agree to abide by terms and conditions of the venue including all WHS policies and procedures;
1.19. Participants agree to follow all lwaful directions given during an emergeny and to become fimiliar with evacuation plans located in the venue;
1.20. "JSA" its employees and/or representatives disclaim any liability, convoluted or contractual for any financial losses or injury that may result from participants not complying with venue policies and procedure or conducting any unlawful act;
1.21. Participants ejected from the training on any day or part of a day and refused re enrty by the trainier will be in contravention of "the terms";
1.22. Participants are to dress in an appropriate manner and have suitable footwear at all times'
1.23. participants may be refused enrty to the training if inappropriately dressed and/or have unsuitable footwear;
1.24. Participants refused entry to the training on any day or part of a day will be in contravention of "the terms";
2. Registrations 2.1. All registrations are to be made online by completing our registration form, returning participants may register their intent to attend another program via email;
2.2. On submitting the registration form and/or email of intent to attend you indicate your acceptance of all of "the terms";
2.3. A confirmation email and will be issued within (5) five business days of receiving the completed registration form;
2.4. Details of the venue address and start, finish times will be included in the confirmation email;
2.5. It is the responsibility of the participant and or the person/s completing the registration to review the confirmation email and if no confirmation is received to contact "JSA" to obtain course location;
2.6. A tax invoice will be sent to the email address entered on the registration form on the same day as the confirmation email;;
2.7. All course fees are due and payable within 7 days of the invoice date or prior to the course start date if less then 7 days;
2.8. Statements will not be issued for public course fees, all fees must be paid prior to commencement of the course;
2.9. Invoices can be paid by EFT, credit card;
2.10. "JSA" reserves the right to change a surcharge on all credit cards if deemed necessary;
2.11 Any credit card surcharge charge will be listed on the invoice;
2.12. Payment by cheque is not acepted at anytime; 2.13. Unless prior approval has been obtained in writing from "JSA" admission to any of our courses may be at risk if payment of course fee has not been made;
2.14. WorkCover NSW requires 100 points of ID for approved courses. If you have insufficient ID on the day you will not be admitted to the course;
3. Certificates 3.1. Certificates will be issued within (10) days of completing a course subject to point 2.7 above;
3.2. It is the responsibility of the person completing the registration to ensure the spelling of each participants name is correct;
3.3. A fee of $25.00 plus $2.50 will be charged for reproducing certificates if the participants name is incorrectly entered or on our registration form or in the email sent for registration;
3.4. It is the participants responsibility for completing our course sign on form and for writting clearly, "point 3.3" above will apply if the name entered is un readable;
3.5. Replacement certificates issued as a result of loss or damage will be charged at $25.00 plus $2.50 GST;
3.6. All certificates will be issued by email in a secured pdf file;
3.7. Information collected by our registration and sign on forms along with all HSR records are kept for seven (7) years as per the regulators requirements and replacement certificates can be requested during this period "point 3.5" applies to all replacement certificates;
3.8. All replacement certificates will be identified as a replacement and include the date that the replacement certificate was issued.
3.9. Once a HSR has commenced the Initial 5 Day HSR training it is a requirement that it must be completed within (6) months of the commencement date;
3.10. A Certificate will not be issued to participants who are unable to complete the program as per point 5.3 below;
4. Cancellations 4.1. Cancellations by "JSA"
4.1.1. "JSA" reserves the right to cancel any course if there are insufficient participant numbers;
4.1.2. "JSA" also reserves the right to cancel any course through "special considerations" as listed in this polic and/or circumstances beyond our control;
4.1.3. Should "JSA" as a result of clauses "4.1" and "4.2" cancel a course all registered participants will be advised by an email;
4.1.4. As a result of "JSA" cancelling a course all course fees paid will be refunded;
4.1.5. "JSA" its employees and/or representatives disclaim any liability, convoluted or contractual for any financial losses that may result from "JSA" cancelling a couse as per "section 4" of "the terms";
4.2. Cancellations by Participants
4.2.1. Participants cancelling their registration must notify "JSA" in writing by email (21) twenty one business days prior to the course commencement date;
4.2.2. Participants failing to notify "JSA" of their intention to cancell the registraion as per "point 4.2.1" above will be in contravention of "the terms";
4.2.3. It is the responsibility of the person and/or participants cancelling the registration to confirm the cancellation with "JSA" prior to the course date;
4.2.4. Failure by the the person and/or participants cancelling to confirm the cancellation with "JSA" will be in contravention of "the terms";
4.2.5. All fees paid will be retained in full by "JSA" for cancellations in contravention of "the terms";
5. Failure to Attend
5.1. Participants failing to attend without on the commencement date or any day or part day of the course without notifying "JSA" in writting or covered under "section 4" of our "refunds policy" will be treated as a contravention of "the terms";
5.2. Participants that are unable to attend any day or part day of the course after obtaining approval from "JSA" may as per the regulators requirements complete the missing day or part day within six (6) months;
5.3. HSR's failing to complete the training within (6) months will be required to attend the full program again before being eligible for a certificate;
5.4. Participants attending a make up day/s as per point 5.2 above will be charged a fee of $120.00 plus GST per day
6. Postponement 6.1 Postponement by Participant
6.1.1. A request for postponement by any participant must be made in writing (14) fourteen business days prior to the course commencement date;
6.1.2. Failure to request postponement as per "point 6.1" unless covered by "section 9" of the "refunds policy" will be treated as a contravention of the "terms";
6.1.3. "JSA" at its discretion and on receipt of the appropriate written request may allow a postponement of attendance for a course and allow attendance at the next available course subject to availability;
6.1.4. All fees paid will be retained and an administration fee of 25% plus GST of the course will be charged in addition to any fees already paid;
6.1.5. The administration fee must be paid prior to attending the next course, failure to pay this fee will be deemed a contravention of "the terms";
6.1.6. No guarantee is given of availability at any upcoming course or that the course will be held within the next (6) six months;
6.1.7. Should the course not be able to be scheduled within (60 six months or attendance by the participant is unavailable at the time of the resechuled course, it will be deemed a contravention of "the terms";
6.2 Postponment by "JSA"
6.2.1. "JSA" reserves the right to postpone and reschedule any course as a result of "special considerations" and or circumstances beyound our control;
6.2.2. "JSA" also reserves the right to postpone and and reschedule any course if there are insufficient participant numbers;
6.2.3. Should "JSA" as a result of section "6.2" postpones a course all registered participants will be advised by an email advising of the and rescheduled date or dates;
7.1. All refunds are subject to our "refunds" policy which can be found by following the appropiate link on the bottom lefthand side of this page;
8.1 First level: Training participant with the Trainer
Trainers are encouraged to acknowledge the participant's feelings as soon as their complaint is made. It may be that the individual believes an early apology may assist in resolving the complaint. When a trainer becomes aware that there is a complaint, that has not been resolved they will inform the participant of the complaints management process in a polite and professional manner.
8.1.1. Recording an early resolution:
If the participant is satisfied with the apology and does not want any further action to be taken, the trainer documents the details and outcomes in their diary and gives a copy of the resolution to the JSA Managing Director. This is to ensure that if in future, the participant wishes to revisit the complaint; records showing appropriate actions previously taken are available for reference.
8.1.2. If unable to be resolved between the participant and the trainer:
The trainer will inform the Managing Director of the complaint and ask them to meet with the participant. As soon as a "Formal of Complaint" is received, the managing director will open a file to document the matter and implement this procedure.
8.2. Second Level: Managing Director
The second level at which complaints will be addressed will be with the MD. This person will investigate the complaint and take appropriate action including documenting the matter on the forms provided. The investigation may include consulting with relevant people who are not directly involved.
Contact with the participant should be immediate with appropriate action being taken within two weeks of being notified of the complaint.
8.3. Third Level: External
The dissatisfied participant, may raise the matter with the Managing Director after having attempted to resolve the complaint within level one or two. The Managing Director will contact an external party to mediate, conciliate or arbitrate the complaint.
Contact with the complainant should be immediate with appropriate action taken within two weeks of being notified of the complaint.
8.4. Confidentiality and Support.
All parties involved with the complaint will respect the privacy and confidentiality of everyone concerned.
A complainant may request the involvement of other key witnesses to the complaint to assist them at any time.
8.5. Related Standards/ Acts:
Anti-discrimination Act 1977, Equal Employment Opportunity Act 1987, Privacy Legislation as at 2002, Workplace Relations Act 1996, Disability Discrimination Act 1992, Fair Trading Act 1985, Conciliation and Arbitration Act 1904, Work Health and Safety Act 2011.
9.1. Venues supplied by "JSA" will comply with all WHS requirements including but not limited to :-
9.1.1. safe access and egress;
9.1.2. access to first aid equipment;
9.1.3. adequate emergency evacuation procedures are in place;
9.1.4. adequate and clean facilities;
9.1.5. suitable heating, cooling and ventilation;
9.1.6. adequate tables and chairs;
9.1.7. suitable lighting
9.1.8. VGA/HDMI connections available if requested
9.1.9. venue and facilities are conducive to adult learning
9.1.10. free of distractions, interuptions and enabling privacy to allow free and open discussion by participants.
9.1.11 'JSA's venue inspection checklist will be used to ensure complience prior to comencing the training.
9.2. Venues supplied by a client are to comply with WHS requirements.
9.2.1. The supplied venue will be inspected by "JSA" prior to the commencement as per point 9.1.11 above;
9.2.2. As a minimum the supplied venue must comply with the requirements of point 9.1 above.
9.2.3 The completed checklist used will be kept on file by "JSA" as per requlator rquirements and be made availbe to the client;
9.2.4 A venue not meeting the minimum requirements of point 9.1 above will not be used;
9.2.5 All costs of finding suitable venue will be meet by the client.
